Standard Term of Business
§ 1 Jurisdiction
For business relations between ACRON MUSIC and the customer only the following standard term of business shall apply. ACRON MUSIC does not accept any other conditions on the part of the customer.
§ 2 Conclusion of a Contract and Withdrawal
The customer may cancel the contract in writing (also by e-mail) or by returning the product within two weeks. If the order value is more than EUR 40,-, ACRON MUSIC will refund the customer for the return shipment. Please note that ACRON MUSIC can keep a depreciation which might occur if the customer used the product.
There is no power of revocation for audio and video recordings (for example CDs, DVDs) and books which have been unsealed by the customer.
§ 3 Delivery
Unless agreed upon differently, the product is send to the address stated by the customer.
§ 4 Payment
The order is made on account. If you return the product unsealed within a fortnight upon receipt, the purchase price will be refunded, however, this does not apply for the forwarding expenses, unless the order value is more than EUR 40,- as mentioned in § 2.
§ 5 Liability for Defects
If the purchased product is faulty, the customer can claim repair of defects or substitute delivery. If this claim is not fulfilled, the customer can withdraw from the contract or can demand a reduction of purchase price on condition that the defect is considerable.
Unless mentioned differently below, further claims on the part of the customer – regardless of any legal arguments - are out of the question. Therefore ACRON MUSIC is not responsible for any damage which does not concern the ordered product itself; in particular ACRON MUSIC is not responsible for any lost profit or other property loss of the customer.
§ 6 Data Protection
Any personal data which are required for carrying our orders and notifications by e-mail are stored by ACRON MUSIC. The customer approves of this acquisition, processing and utilization of personal data.
After completion of the transaction and after legal period for keeping the data they will be deleted.
§ 7 Applicable Right
German law not including UN law on sales shall prevail.
